Terms and Conditions of Sale

Article 1 – Scope

These general terms and conditions of sale (hereinafter the “GTC”) govern exclusively all contractual relations between CALOINE SRL, VAT number BE 0686.908.666, hereinafter referred to as the “Company” or “Siprès,” and any natural or legal person visiting the website or purchasing products via the website http://www.sipres.be (hereinafter the “Customer”).

The Customer’s own general or specific conditions shall not be enforceable against Siprès, unless previously accepted in writing.

Any order placed on the Website implies full, complete, and irrevocable acceptance of these GTC.

Article 2 – Purpose of the website

The website http://www.sipres.be  (the “Website”) is an e-commerce site operated by Siprès, allowing the online sale of natural cosmetic products (hereinafter the “Products”).

Article 3 – Legal capacity

The Customer declares that they have the legal capacity required to enter into a purchase contract on the Website.

When the Customer acts on behalf of a legal entity, they declare that they are duly authorized to bind it.

Article 4 – Website content and intellectual property

The entire Website, its content (texts, images, graphics, logos, videos, packaging, formulas, processes, know-how), and content shared on Siprès social media are protected by copyright and, more broadly, by intellectual property rights.

Any reproduction, representation, modification, or use, in whole or in part, without prior written authorization from Siprès is strictly prohibited.

Product visuals and descriptions are provided for informational purposes only and have no contractual value. Photos and illustrations may include items not included in the price. The Customer is solely responsible for product selection and purchase.

Article 5 – Product and health information

The information on the Website does not constitute medical advice, diagnosis, or prescription.

Siprès Products are cosmetic products, not food products.

Only a healthcare professional is authorized to provide a diagnosis or treatment.

Article 6 – Liability related to website use

Siprès shall not be held liable for damages resulting from:

• use of the Website,

• improper use of the Customer’s computer equipment,

• viruses, hacking, or unauthorized intrusion beyond its control.

Article 7 – Products

Products are manufactured in accordance with applicable Belgian and European standards and according to the specifications described at the time of order.

Article 8 – Order

The Customer selects Products, validates their cart, accepts the GTC, and proceeds to payment..

The sale is concluded only after:

• receipt of full payment,

• sending of an order confirmation email by Siprès.

Siprès reserves the right to refuse or cancel an order in case of dispute, obvious pricing error, stock shortage, or suspected fraud.

Products remain the property of Siprès until full payment is received.

Article 9 – Availability

Offers are valid while stocks last and within the validity period of the relevant offer.

Article 10 – Cancellation before shipment

Order cancellation is only possible before products are shipped.

Article 11 – Right of withdrawal (consumers only)

In accordance with Belgian law, the Customer has 14 calendar days from receipt of the order to notify withdrawal at bonjour@sipres.be.

Products must be returned unopened, unused, in their original packaging, including any gifts received if applicable, at the following address : Boulevard de la Fleur de Lys 22 – 1400 Nivelles – Belgium

Return costs are borne by the Customer.

Sealed products cannot be returned for hygiene reasons.

Refunds are issued within 14 days, in the form of a voucher for a future order.

Article 12 – Pricing and payment

Prices are shown in euros, including VAT. They may be modified at any time and do not include delivery fees unless otherwise stated.

Prices paid are those shown at the time of order confirmation, except in case of obvious error.

Delivery fees are shown before order validation and added to the total.

Claims regarding invoices must be submitted within 8 calendar days of receipt.

Payment is made via secure methods offered on the Website.

Article 13 – Delivery

Indicative delivery times:

• Belgium : up to 5 working days

• Europe : up to 10 working days

Risk transfers to the Customer upon receipt of the Products.
If a parcel is damaged, the Customer should refuse delivery. If damage is discovered after receipt, the Customer must contact [bonjour@sipres.be](mailto:bonjour@sipres.be) within 24 hours with photos.

Siprès is not responsible for delivery issues caused by incorrect Customer information.

If the Customer is absent or fails to collect the parcel, reshipping costs (delivery fees + €3 preparation fee) will be charged.

Article 14 – Legal warranty

Siprès is bound by the legal guarantee of conformity under Belgian law.

Article 15 – Product use

The Customer agrees to follow usage and storage instructions provided on packaging and the Website.

Article 16 – Liability

Siprès is not liable for damages resulting from improper use of products.

Liability is limited to direct and foreseeable damages, up to €500, except in cases of gross negligence or intent.

Article 17 – Force majeure

Siprès is not liable in cases of force majeure (strike, fire, pandemic, supply disruption, IT failure, etc.).

Article 18 – Personal data

Personal data is processed in accordance with the Privacy Policy available on the Website.

Article 20 – Customer reviews

The published reviews are authentic, unpaid, and moderated according to the following criteria:

• They must reflect a genuine experience of using the product.
• They must not contain violent, offensive, hateful, or otherwise inappropriate content that may be unsuitable for other users.
• They must relate to the use of the product or the website.

Article 21 – Resale prohibition

Resale of Products outside the Siprès network is strictly prohibited.

Article 22 – Severability

If any provision of these General Terms and Conditions is held to be invalid, illegal, or unenforceable, such determination shall not affect the validity, legality, or enforceability of the remaining provisions. Any failure by Siprès to require strict compliance with one or more provisions of these General Terms and Conditions shall not be construed as a waiver of its rights and shall not prevent Siprès from subsequently enforcing strict compliance with those provisions.

Article 23 – Governing law and jurisdiction

These GTC are governed by Belgian law. The French version prevails over any translation.

In the event of any dispute relating to the execution and/or interpretation of the order, Siprès and the Customer shall endeavour to resolve the dispute amicably. Further information on the amicable settlement of disputes is available on the European Online Dispute Resolution platform.
Failing an agreement between the parties, the dispute shall be submitted to the courts of Brussels, Belgium, which shall have exclusive jurisdiction.
